1. Agreement to Terms

Welcome to Fanfits! These Terms of Service (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Fanfits / Thu Phuong Trading One Member Company Limited (“we,” “us,” or “our”), concerning your access to and use of the https://fanfits.net website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.

Our Privacy Policy, Shipping Policy, Return & Refund Policy, and Payment Policy are also part of our legal agreement with you and are incorporated by reference into these Terms.

2. Intellectual Property Rights

Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

You are granted a limited license to access and use the Site for your personal, non-commercial use only. 3. User Accounts

You may be required to register with the Site to access certain features. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable. You must provide information that is accurate, complete, and current at all times.

4. Products, Services, and Orders

A. Product Information We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products.

B. Pricing All prices are listed in Vietnamese Dong (VND). We reserve the right to change prices for products displayed on the Site at any time and to correct pricing errors that may inadvertently occur.

C. Order Acceptance Placing an order constitutes an offer to buy the products. All orders are subject to our acceptance. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the product, or fraud detection.

D. Customization and User-Submitted Content For customized products, you are solely responsible for the content (e.g., logos, names, numbers, images) you submit. By submitting content for customization, you represent and warrant that:

  • You own or have the necessary licenses, rights, consents, and permissions to use and authorize us to use the content.

  • The content will not infringe upon the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party.

  • The content is not libelous, defamatory, obscene, pornographic, or otherwise illegal.

You agree to indemnify and hold us harmless from any and all claims, damages, and expenses arising from your breach of these warranties. We reserve the right to refuse to print any content that we, in our sole discretion, deem to be in violation of these terms.

5. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. Prohibited activities include, but are not limited to:

  • Systematically retrieving data or other content from the Site to create a collection, compilation, database, or directory without written permission from us.

  • Using the Site in any way that is illegal, fraudulent, or harmful.

  • Engaging in any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email.

  • Uploading or transmitting (or attempting to upload or to transmit) viruses, Trojan horses, or other material that interferes with any party’s uninterrupted use and enjoyment of the Site.

6. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site or our products, even if we have been advised of the possibility of such damages.

Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the products purchased.

7. Governing Law and Dispute Resolution

These Terms and your use of the Site are governed by and construed in accordance with the laws of Vietnam. Any legal action or proceeding relating to your access to or use of the Site or these Terms shall be instituted in a state or federal court in Ho Chi Minh City, Vietnam. You and we agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.

8. Changes to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Service at any time and for any reason. We will alert you about any changes by updating the “Effective Date” of these Terms. Your continued use of the Site after the date such revised Terms are posted will constitute your acceptance of the changes.
